The order regarding the bail plea of Anirban Bhattacharya and Umar Khalid -JNU students who are in jail on sedition charges since their surrender on February 23 -- will be issued on March 18, a Delhi court has said.
The police say the two were the main organisers of an event held in the campus on February 9 in support of executed Parliament attack convict Afzal Guru, during which anti-national slogans were raised.
The prosecution told the court today that the two had led the crowd which raised anti-India slogans and there were 10 eyewitnesses unaffiliated to any political party or group, who have confirmed this. They were also the ones who sought permission from the university authorities for the event, finalised the posters and got them printed, the prosecution said.
Asking for bail, the defence counsel argued that Umar Khalid was a PHD student who has only six months to complete his dissertation and he has been cooperating with the investigators.
In an apparent U-turn, the police also claimed today that JNU students' union president Kanahiya Kumar, who spent nearly 40 days in jail on sedition charges for the same event and is currently out on bail, was not the main organiser of the event.
Mr Kumar was arrested on sedition charges on February 12 for allegedly making anti-national statements - triggering a huge political controversy and a nationwide debate on freedom of speech.
A high-level probe panel of the university has already sent show-cause notice to Umar and Anirban, finding them "guilty" of arousing "communal, caste or regional feeling or creating disharmony among students".
They were among the 21 students who were found to have violated university norms and disciplinary rules. The panel is believed to have recommended rustication of Kanhaiya, Umar, Anirban and two other students for their alleged role in the controversial event.
