Allahabad: The Allahabad High Court has slammed the Mayawati government for its refusal to lodge a First Information Report (FIR) in a complaint of rape in the aftermath of the land acquisition violence in the twin villages of Bhatta and Parsaul.
Justice SC Agarwal of the Allahabad High Court said that the state government had no business to challenge the lower court's decision ordering the police to register an FIR on the complaint of the victim.
The victim had filed a complaint before the Station House Officer (SHO) of the Dankaur Police Station, alleging rape by the Provincial Armed Constabulary (PAC) jawans deployed in Bhatta-Parsaul after farmers clashed with policemen during the land acquisition agitation.
Criticising the SHO of the Dankaur Police Station for delaying the lodging of the FIR by filing petitions in the court, Justice Agarwal said "The SHO concerned or the State has no business to file a writ petition to challenging the lower courts order directing him to lodge an FIR. When the person responsible for conducting a fair investigation, from the very beginning, is prejudiced and is reluctant to even register the FIR, one may wonder whether any impartial or fair investigation can be conducted by the police in this case."
Angry with the state governments move to challenge the lower courts order the judge said, "a prospective accused, the SHO has no right to challenge the lower court's order."
