What Are The Terms And Conditions For The Contest?
Welcome to NDTV Big Bonus Raksha Bandhan Giveaway ("Contest") organised and managed by Enigmatic Smile Rewards Private Limited ("Enigmatic" / "us" / "we" / "our") through our mobile/digital application under the brand name "NDTV Big Bonus" ("Application").
By registering through the Application, you ("you" / "your" / "user") will be eligible to participate in the Contest and win exiting rewards up to INR 5,000/-, subject to the terms and conditions herein below ("Terms").
Any user participating in the Contest shall be bound by the Terms and all other rules, regulations and terms of use referred to herein or provided by Enigmatic in relation to the Contest. If you do not agree or accept the Terms and all other rules, regulations and terms of use referred to herein or provided by Enigmatic in relation to the Contest, you are advised not to participate in the Contest.
1. The Contest shall start on 12th August, 2024 and will conclude on 31st August, 2024 at 11:00 pm. However, Enigmatic reserves the right to change the duration, rules or terms and conditions.
2. All users willing to participate in the Contest must be resident of India. Users below the age of eighteen (18) years are not allowed to participate in the Contest.
3. For participating in the Contest, user must download the Application, register on the Application, and obtain a User ID.
4. Users agree to provide true, accurate, current and complete information at the time of registration and at all other times (as required by Enigmatic. Users further agree to update and keep updated their registration information.
5. Upon successful registration, user will become eligible to participate in the Contest. User hereby confirms that he / she is participating in the Contest in personal capacity and not in the course of any business and/or profession.
6. To win exciting Rewards (as defined below), users are required to describe their sibling in 3 (three) words. The users are required to send the answer along with the Application User ID by way of either Direct Message (commonly referred to as 'DM') or comment on one of our Contest social media posts on NDTV Big Bonus official social media handles i.e., https://www.instagram.com/ndtvbigbonus, https://x.com/ndtvbigbonus and https://www.facebook.com/ndtvbigbonus/.
7. Each user is allowed to submit only one entry against his/her Application user ID.
8. The winners will be selected by us based on the creativity and originality of the responses. The entries with the most imaginative and creative response will be entitled to earn any of the following rewards ("Rewards"):

9. The results of the Contest will be announced on 3rd September, 2024 on NDTV Big Bonus official social media handles i.e., https://www.instagram.com/ndtvbigbonus, https://x.com/ndtvbigbonus and https://www.facebook.com/ndtvbigbonus/.
10. The Rewards will be credited to the User's Application wallet, which can be redeemed only on the Application to purchase products of merchants available on the Application.
11. The Rewards are non- transferable and are non-exchangeable, and no cash will be offered to any user in lieu of such Reward in any circumstances. Additionally, to be eligible for Rewards, the user's credit or debit card must be linked to their account on the Application.
12. User understands, agrees and acknowledges that we shall not be responsible and/or liable for any transaction pursuant to the redemption of the Reward, and any product related claims/liabilities shall entirely vest with the merchant.
13. All the rights including but not limited to the intellectual property rights, copyrights and all other allied, ancillary and subsidiary rights in any and all media in and to the photographs, tapes, movies and recordings of everything related to the Contest shall vest with Enigmatic absolutely for perpetuity, throughout the world.
14. Further, the user grants an unlimited, transferable, sub-licensable right and license to (a) use user's photographs and videos for promotion in the manner as deemed fit by Enigmatic; (b) name the winners of the Contest on Application, website or social media handles and use the same for promotion and marketing purposes; (c) use personal information of the user to contact him/her for testimonials and promotions after the Contest; (d) use the personal information of the user for purposes defined under Application's privacy policy.
15. By participating in the Contest, user expressly, freely and unambiguously consent to the collection, use, disclosure, transfer and retention of his/her personal information in accordance with Application's privacy policy. In order to learn more, we recommend users to read and understand the privacy policy in entirety.
16. We, at our sole discretion, reserve the right to alter and amend the benefits and/or Rewards and/or their criteria, in such manner, as we may, in our sole discretion deem fit.
17. Further, we, at our sole discretion, may disqualify any user from the Contest, refuse to award Rewards and require the return of Rewards, if the user engages in unfair conduct, which we deem to be improper, unfair or otherwise adverse to the operation of the Contest or is in any way detrimental to other users.
18. Users shall participate in the Contest voluntarily and at their own risk. It is the sole responsibility of the User to ensure that they are entitled to participate in this Contest as per the applicable law.
19. We shall, under no circumstance, hold liability and/or responsibility for any damage, loss, injury or disappointment incurred or suffered by any user through its participation in the Contest (as a result of acceptance of any Rewards).
20. The decision of Enigmatic and / or its representatives, employees, directors, officers or agents with respect to the choice of questions or the manner of choosing of winners will be final and binding on all users.
21. Enigmatic reserves the right to cancel or postpone the Contest without giving any reason and shall not be held liable for any such cancellation or postponement.
22. Users hereby release from and agree to indemnify us, and our directors, employees, associate partners and licensors, from and against all liability, cost, loss or expense arising out their participation in the Contest including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission on their part, or otherwise.
23. In no event shall Enigmatic's liability for any claim made by any user for any reason exceed Rs. 5,000/-.
24. We shall have no liability for any act or omission beyond our control including but not limited to earthquake, flood, pandemic, epidemic, strike, lockout, labour controversy, riot, telecommunication failure, internet breakdown, software disruption, civil disturbance, war, civil commotion, etc.
25. The provisions contained in these Terms shall be read, in addition to and not in derogation of, our other terms including but not limited to Terms of Use, Privacy Policy, Cookies Policy, etc. ("Other Terms"). In case of any discrepancy between these Terms and Other Terms, the provisions of these Terms shall prevail.
26. In case users have any complaints or grievance pertaining to offering and running of the Contest and/or these Terms, please share the same with us by writing to bigbonuscontest@gmail.com. On receiving such complaint, grievance or notice, we reserve the right to investigate and/or take such action as we may deem appropriate. We may reach out to the user to seek further clarification or assistance with the investigation, or verify the statements made in user's complaint, grievance or notice, and user acknowledges that his/her timely assistance with the investigation would facilitate the redressal of the complaint.
27. Any dispute arising out of these Terms shall be governed by the laws of India and shall be subject to exclusive jurisdiction of courts at New Delhi.
