1984 riots case: Delhi court frames charges against Sajjan and others

New Delhi: A Delhi court on Friday  framed charges of murder, criminal conspiracy andspreading enmity between two communities against Congressleader Sajjan Kumar and others in a 1984 anti-Sikh riots case.

Additional Sessions Judge Sunita Guptaordered framing of charges against Kumar besides BalwanKhokhar, KrishanKhokhar, Mahender Yadav, Captain Bhagmal andGirdhari Lalunder various sections of IPC.

The court framed charges under Sections 120-B(conspiracy), 302 (murder), 395 (dacoity),427 (mischief causing damage to property), 153A (promotingenmity between different communities), 436 (mischief by fireor explosives) under the IPC.

All the accused including Kumar pleaded notguilty and expressed their willingness to contest thecharges against them.

The court had on May 15 ordered framingof charges against the Congress leader in an anti-Sikhriot case relating to murder and spreading enmity between twocommunities after finding prima-facie evidence against him.

CBI had accused Kumar of provokingpeople against members of a particular community during thecarnage that followed the assassination of prime ministerIndira Gandhi on October 31, 1984, leading to the killing offive persons in Delhi Cantonment area.

In his defence, Kumar had claimed beforethe lower court that the accounts of CBI witnesses werenot reliable as they had changed their versions a number oftimes.

The former Outer Delhi MP had alsocontended that the case against him could not stand as CBIre-registered it even though a Delhi court had given him a cleanchit, accepting a cancellation report filed by Delhi Police.

CBI had filed two chargesheets againstKumar and others on January 13 in the riots cases  registered in 2005 on the recommendation of Justice G T NanavatiCommission which inquired into the sequence of events leadingto the communal riots.
