Mumbai:
Two years after he was charged with parking his car in no-parking area, a man has been acquitted by the magistrate's court in Mumbai.
Anil Gidwani, who was acquitted by Esplanade court, had earlier moved the High Court with a PIL highlighting pendency of a petty traffic rules-related case against him.
Gidwani's car was towed away in April 2007 from the pavement near Cooperage ground. He claimed that he hadn't parked in no-parking area.
Since he refused to pay fine, maintaining that he wasn't guilty, a case was filed first in the `morning court' where petty offences are tried.
Trial began, but the traffic constable concerned didn't appear in the court for eight months. When Gidwani said that he had lost faith in the court, the case was transferred to Esplanade court.
There too, the trial dragged on. Finally he moved the High Court.
High Court last month asked the court registrar to obtain details of pending cases from 37th magistrate's court in the Esplanade court complex in south Mumbai, and directed the Magistrates court to conclude Gidwani's trial within 30 days.
Since the constable who had charged Gidwani could not produce any evidence, Gidwani was acquitted by magistrate's court two weeks ago.
