Cop fined for not filing reply

Mumbai: The Bombay High Court has imposed a cost of Rs 5,000 on a senior police inspector, Economic Offences Wing (EOW), for not filing reply to a petition despite court's order.

The cost shall be paid by the officer from his own pocket, said division bench of Justices B H Marlapalle and R Y Ganoo.

The court also noted, in the order last week, that though the petitioner Bhagyashree Shrikant Lele had filed complaint of cheating against her brother-in-law and officials of Modi Xerox Ltd way back in 2000, EOW is yet to file a chargesheet.

Lele moved the court after seeing that EOW was dragging its feet. In the petition, she has sought direction from the court that chargesheet be filed.

Judges had sought reply from investigating officer in two weeks on November 11. On the next date, prosecution sought more time, which was granted.

But even on December 17, when matter came up again, EOW had not filed reply. Angered, judges imposed cost.

According to the petitioner, who had dealership of Modi Xerox products, her brother-in-law duped her in connivance with Modi Xerox officials to the tune of around Rs 67 lakh.

Her petition alleges that EOW went slow because a big company is involved.
