Seven-year-old Piya Choudhary has demanded compensation of Rs 25 lakh from her school and class teacher for damaging her eye.
Choudhary, who lost the ability to see from her left eye after being reportedly beaten by her class teacher, has filed a writ petition in the Rajasthan high court.
She has also asked for directions to the state government and Rajasthan State Commission for the Protection of Child Rights (RCPCR) to frame rules and guidelines and formulate a plan of action to ban corporal punishment in schools.
Taking her petition on Thursday, Justice Ajay Rastogi issued notices to the state government, RCPCR and Central Board of Secondary Examination (CBSE) along with seven other persons. Choudhary, a student of Tagore School at Sitasar in Jhunjhunu district, was allegedly slapped and hit with a note book by her class teacher Pratibha Singh for failing to do her homework.
Piya's counsel AK Jain has argued in the petition that the petitioner is a child and her right to life and her right to education and development have been violated despite the fact that the CBSE prohibits corporal punishment in all schools affiliated to it.
However, the school administration not only supported the teacher responsible, but is also guilty of criminal conspiracy. Besides, no action has been initiated by the district administration against the teacher and the school administration. While, Piya has asked a compensation of Rs 25 lakh from the school and the class teacher, she has requested the court to give directions to the state government to initiate enquiry and cancel the license and allotment of land to the erring institute.
She has also asked the court to direct the CBSE to initiate enquiry as per the rule and further cancel affiliation of the erring school.
