The Delhi High Court today asked Delhi University Teachers Association(DUTA) not to restrain any of the teachers who volunteer to associate themselves with the preparation of new time table in their respective colleges keeping in mind the future of students.
However, the court said its order was not a mandate on the faculty members to associate themselves in college affairs.
Justice S Ravindra Bhat made it clear that the Delhi University (DU) can take legal recourse against the teachers if they do not participate in preparing the time-table as the classes were yet to start. The faculty members have been protesting against the University's decision to implement semester system in undergraduate science courses from this academic year.
Justice Bhat disposed of a petition filed by DU seeking an injunction restraining the teachers from going on strike or resorting to any other mode of protest. "The defendant(DUTA) was directed not to prevent the teachers who voluntarily associate in preparing the time-table for under graduate course...," said Justice Bhat.
The court's order came after the both the parties failed to resolve the issue through mediation last month.
According to the University, the teachers, as a protest, had withheld the internal assessment marks of students and later they released it following an intervention of this court. In the petition, the University alleged that due to gherao and demonstration, smooth functioning of the administration, educational and examination system had been affected.
Following a letter from the University Grant Commission (UGC) on March 21, DU has implemented the semester system for undergraduate students.
DUTA has been opposing the semester system for a long time but matters came to a head when Vice Chancellor Deepak Pental approved the new curricula for 12 science courses at the Academic Council meeting in May.
According to Council members, he had passed the curriculum without discussion and walked out of the meeting.
