The sessions court on Thursday convicted Neil Nobert Creado, 47, for attempting to murder his father Nobert Alfred Creado, 79, in March 2008. Neil was convicted under sections 307 (attempt to murder) and 323 (causing hurt) of the IPC and sentenced to three years of rigorous imprisonment.
"On March 19, 2008, I was entering my home when I heard someone say 'I will kill you' and immediately I received a blow on my neck. I turned and saw it was my son Neil with a chopper in his hand," recollected Nobert in the court on February 4, 2009.
Nobert suffered injuries on his chest, cheek, and the back of his neck. Neil's brother Shailesh Nobert Creado, who was an eyewitness had told the court that he suddenly heard his father scream and rushed to the room and found Neil attacking his father with the chopper. When he tried to stop his brother, he was attacked as well, but escaped with minor injuries.
"When we took my father to Cooper hospital, the doctors referred him to Nanavati hospital as his condition was very critical," said Shailesh.
Shailesh had also told the court that Neil had attacked them on several occasions as he was suffering from some psychological disorder. The defense had even argued that he was undergoing treatment for schizophrenia since the last 29 years. In fact, on November 3, 2008, the matter was adjourned awaiting medical reports.
However, the arguments of his being mentally unsound could not be validated, and he was convicted. However, he has been allowed to set off the punishment period with the time it took for the inquiry, investigation and the trial.
