Woman says 'errant' husband cruel; gets maintenance
New Delhi: A Delhi court has come to the rescue of a woman, who accused her husband of cruelty by claiming he maintained extra-marital relations, by ordering him to pay her maintenance under the Domestic Violence Act.

Metropolitan Magistrate Twinkle Wadhwa took into account the photographs of the woman's husband with different women, including those in Russia, as well as interiors and exteriors of their house, showing his financial health besides other documents to prove her charge.

"Complainant has been able to prove that her husband had treated her with cruelty. She has further proved that her husband had relations with other women outside wedlock.

"She has been able to prove that her husband had neglected to maintain her despite the fact that he is earning lakhs of rupees," the court said.

The court presumed the income of husband, who runs an engineering works factory, at Rs one lakh per month and awarded maintenance of Rs 20,000 to the woman who has two sons of 18 and 16 years following their marriage in 1988.

The husband had denied the charges relating to his relationships with other women, claiming the photographs produced by his wife were quite old and had been taken when he visited Russia which he said has a very open society.

The woman demanded maintenance of Rs five lakh per month from her husband claiming his income to be around Rs 10 lakh per month. She produced electricity bills of their West Patel Nagar house and tickets of air travel to prove her points.
