Emphasising that the courts should deal strictly with cases of child sexual abuse or else society will lose confidence in them, a Delhi court has jailed two men for behaving in a "vulgar manner" with a minor girl.
"These kind of incidents shock the conscience of the court as well as of the society. These issues if not taken seriously would erode the confidence of the society in courts," Metropolitan Magistrate Kiran Gupta said.
The court made the remarks while sentencing Karol Bagh residents Mukesh and Vijay to three and two years in jail respectively for sexually assaulting an eight-year-old girl. The judge also slapped a fine of Rs 10,000 on Mukesh and Rs 3,000 on Vijay.
The incident dates back to July 2008. The girl was playing outside her house when the duo took her to a secluded place and took turns to assault her.
The girl told the court that after the incident Vijay apologised to her while Mukesh threatened her not to disclose it to anyone.
The incident came to light when the girl went back home and her mother saw scratch marks on her body. Upon enquiry, it was found that the duo had allegedly made her drink their urine.
However, subsequently she told the court that she was sexually assaulted by the two men, who were held guilty under Section 377 IPC (for unnatural offence) as the court held that the minor improvement in her description of the nature of incidents was due to lack of understanding of a minor girl.
"Both the convicts misbehaved in a vulgar manner with an eight-year-old girl. Such instances do not only physically ravish the victim but also create trauma on the psyche of the victim," the magistrate said.
