Man gets death penalty for raping, killing 4-year-old girl

Delhi: A Delhi court today awarded death penalty to a man for stabbing to death a four-year old daughter of his colleague after raping her in 2005, saying the offence was "brutal and gruesome".

"Instead of taking care of the daughter of his colleague, he acted in extreme brutal, grotesque and diabolic manner so as to arouse extreme indignation of the society in committing rape of the 4-year-old child and thereafter, committed her murder by slaughtering her from private parts up to chest," Additional Sessions Judge S C Rajan said.

Sending convict Mukesh Kumar, a resident of Lakadpur in Faridabad, to the gallows is the only deterrent punishment which could be awarded in the case, the court said.

"In my considered view, there is something uncommon about this crime and the circumstances of the crime are such that there is no alternative but to impose the death penalty," it said.

The court rejected the plea of convict that a lenient sentence be awarded to him on the ground that he was 26 years of age and a first-time offender.

"It is inconceivable that a baby child can arouse the devouring demon in a man, more particularly whom she saw being on visiting terms with her family, to this extent and nothing can be more degrading and de-humanising," it said.

The court also imposed a fine of Rs 15,000 on the convict for offence of kidnapping, rape and murder saying "he shall be hanged by the neck till he is dead."

The accused, who used to work as a barber with the father of the victim at a saloon in Okhla Industrial Area, went to the house of the girl and demanded Rs 1,500 from her mother for purchasing a refrigerator on June 12, 2005.

After the mother of the victim refused to pay the money, the accused took the girl away on the pretext of getting her some chocolates. A report was lodged at the police station after she did not come back which led to the arrest of an accused who got recovered the naked and mutilated body of the victim from a tank in the area.

The court, which examined 13 witnesses, concluded "the prosecution has proved each and every circumstances to connect the accused and these circumstances unerringly pointing towards the guilt of the accused. The complete chain of circumstances has been formed by the prosecution."

"Accused Mukesh has committed shocking, brutal, heinous and dirty act," the court said in its verdict.
