Nursery Admission: Setback For Government Of Delhi, HC Stays New Admission Norms
Delhi High Court stays Government's new admission norms
New Delhi: New admission criteria for nursery admissions in Delhi which were notified by the Aam Aadmi Party Government have been stayed by Delhi High Court today. The court said that the neighbourhood criteria is "arbitrary and discriminatory". Justice Manmohan said the interim stay on the January 7 notification would remain in place till final disposal of the pleas challenging the Delhi government's order to private unaided schools to accept nursery admission forms based only on the neighbourhood or distance criteria, reported Press Trust of India.

Delhi High Court was hearing petitions filed by parents and two school associations challenging the December 19, 2016 and January 7 notifications by Arvind Kejriwal government that made 298 private schools, built on Delhi Development Authority (DDA) land, to accept nursery admission forms based only on the neighbourhood or distance norm. According to the January 7 notification, the government said that the students from 1-6 kilometers radius would be preferred for the admission process first, in which students residing within 1 km given the first preference.

The court had earlier had asked the state government and centre government to explain their stands on the neighbourhood or distance norm.

Today, the court also said that the Directorate of Education (DoE) of the Delhi government "cannot do indirectly what it cannot do directly". February 14, ie today is the last date for filling the applications in the Delhi Nursery Admissions.

According to a report from last week, the Delhi government had received over one lakh online applications against 31,000 seats for nursery admission in private schools under Economically Weaker Section (EWS) category. Nursery admission procedure in Delhi has been marred with legal issues for last two three years.

The court by way of an earlier interim order had allowed the parents to fill up the application forms for the various schools based on the criteria set by them as well as the Delhi government.

Accordint to reports, parents and schools welcomed the Delhi  High Court decision on the nieghbourhood criteria.
