A week after Mumbai police chargesheeted actor Suraj Pancholi for allegedly abetting suicide ofhis actress girlfriend Jiah Khan, her mother is set to movethe Bombay High Court seeking direction to police to considerthe material given by her which indicated she was murdered.
Rabiya Khan, mother of the British-American actor who wasfound dead at her Juhu home on June 3 last year, said policehad not considered the material provided by her despitespecific instructions from the high court.
Police had last week filed a 447-page charge sheet in anAndheri court accusing Suraj of abetting Jiah's suicide on thebasis of evidence gathered during the investigation, which didnot indicate it was a case of murder.
"There was no evidence to show that Jiah was killed. Wehave gone into the material given by her mother but have notfound any evidence to support the theory that it was a case ofmurder," a top police officer told PTI.
Rabiya, however, is not convinced with the findings ofthe probe and would seek the help of the high court to get thepolice to investigate the matter afresh from the angle ofmurder.
"They (police) have not done a thorough probe. They havenot properly probed the murder angle despite the high court'sdirection," she said.
"We shall move the Bombay High Court next week seekingthat the police probe the aspect of Jiah Khan's murder as theyhave ignored the material given to them by Rabiya stronglysuggesting that her daughter had been killed," her lawyer,Dinesh Tiwari, said.
In support of her claim that 25-year-old Jiah, who hadmade a high-profile debut opposite Amitabh Bachchan in RamGopal Varma's Nishabd, was murdered, Rabiya said humantissues found in her nails indicated struggle before death.However, police have said the tissues were Jiah's own,while ruling out murder.
Soon after Jiah's death, her mother had handed over aletter purportedly written by the actor which showed she wasin a troubled relationship with newbie actor Suraj, son ofactor couple Aditya Pancholi and Zarina Wahab. Suraj, who wasyounger to Jiah, was arrested on the charge of abetting hersuicide and later granted bail.
Rabiya had moved the Bombay High Court in October, 2013alleging that her daughter was murdered and sought a CBIprobe. Following this, the court had asked police to recordher statement on those lines, collect material given by herand probe the murder angle.
As the police have claimed to have already probed theallegation that Jiah could have been murdered but found nocorroborative evidence, Rabiya would again knock the doors ofthe high court, her lawyer said.
To support the murder theory, Rabiya had placed beforethe high court, and later the police, an independent forensicexpert's report which indicated that the case was of homicidaldeath rather than suicide.
Alleging shoddy investigation by the police to helpJiah's boyfriend, Rabiya had said that the deceased actor mayhave been hanged after being killed in order to make it looklike suicide.
Her petition in the high court had cited reasons tosupport this theory. She had contended that a person whocommits suicide would have eyes popping out and tongueprotruding which was not the case in Jiah's death.
Also, in such cases, lung or brain haemorrhage isgenerally noticed but in this case that was also not observed.The petition said that besides ligature marks that occur indeath due to hanging, injury marks were noticed on the faceand body of the actor. An injury was noticed on right side ofher lips and a mark on her left arm as if someone had held hertightly.
While the police claimed that Jiah had hanged herselfwith a muslin 'dupatta', forensic expert R N Jerajani heldthat the depth of ligature marks on Jiah was difficult to havebeen caused with a soft material.
Jerajani had said the ligature marks on Jiah's neck werenot the ones usually found on the body of a person who hangsself from a ceiling fan. "The possibility of strangulation isnot ruled out in this case," he had said in the forensicreport.
The petition further said that CCTV camera showed Jiahentering her home a few minutes before she ended her lifewearing a track suit, but her body was found in a night gown."Would a person about to commit suicide change her dress?"Rabiya had wondered in her petition.
