The 24-year-old actress is due in court on Friday and is likely to be sent to jail for probation violation after her camp and the prosecutors failed to work out a plea deal, reported TMZ.
The case is set to go before the jury instead and Lohan is likely to go to jail, pending trial.
Meanwhile Kamofie and Co, the jewellers from where Lohan allegedly stole a USD 2,500 necklace are planning to auction it off.
The move could undermine the case even further, after the shop, located in Venice, Los Angeles, controversially sold the surveillance footage of Lindsay inside the store on January 22 for a reported $ 35,000.
It was aired on US channel Entertainment Tonight and shows Lohan, 24, chatting with a clerk while trying on several necklaces, all but one of which she quickly removed, according to the show.
