The Uttarakhand High Court has stayed the arrest of Bollywood producer-director Rakesh Roshan till September 19 in a civil suit filed against him for infringement of copyright, an official said on Wednesday.
On May 21 of this year, Dehradun-based writer Roop Kumar Sonkar lodged an FIR against Rakesh at the Dalanwala police station accusing him of using some parts of his novel in the 2013 film Krrish 3 which starred the filmmaker's actor son, Hrithik Roshan, in the titular role.
The case, which was filed under section 63 of the Copyright Act 1957, alleged that superhero film Krrish 3 had similarities with Roop Kumar's book Suardaan in terms of story and characterisation. The hearing was set for August 29.
Rakesh then proceeded to request the court to quash the FIR and not take any action against him till September 19, part of which was refused by Justice UC Dhyani. The court has decided on Tuesday that it will take a decision on September 19 if the producer should be arrested or not.
The Krrish director said the script, co-written by him, was original and that there was no copyright violation.
Meanwhile, an FIR based on similar allegations has been filed by Roop Kumar in Lucknow, and is still pending action.
