Mumbai: The prosecution on Thursday wrapped up itsarguments before the Bombay High Court in the 2002 hit-and-runcase involving actor Salman Khan. It urged the court'not to show any leniency' to the actor and to uphold the five-year imprisonment sentence awarded to him by a sessions court in May this year.
The prosecution maintained that only three persons werepresent in the car - Salman Khan who was driving the vehicle,his bodyguard and policeman Ravindra Patil, and the actor'sfriend, singer Kamaal Khan.
The prosecution had also discarded the defence's theorythat Salman's driver Ashok Singh was driving the car at thetime of the incident and that he had lost control of thevehicle after its tyre burst.
Public prosecutor Sandeep Shinde and Purnima Kanthariahad in their arguments earlier said the actor was drunk at thetime of the incident and his breath smelt of alcohol even whenhe was brought to the hospital for medical check-up the nextday.
While concluding the arguments on Thursday, Mr Shinde citedseveral judgements of the Supreme Court including the 1999Sanjeev Nanda case and 2005 Alistair Pereira case.
The trial court had on May 6 held Salman guilty ofculpable homicide not amounting to murder, upholding thepolice's case that he was drunk and was driving the car whenthe incident took place on September 28, 2002.
