New Delhi: The Supreme Court today dismissed the petition of dentist couple Rajesh and Nupur Talwar seeking the reports of polygraph, narco-analysis and brain-mapping test conducted on three domestic helpers who were initially accused in the murder case of their teenage daughter Aarushi.
The Talwars, who are facing trial for allegedly killing their daughter in 2008, had pleaded that they needed the reports to defend themselves. Their lawyer had said in the court that the tests done on Raj Kumar, Vijay Mandal and Krishna suggested the possibility of their involvement in the murder.
The CBI however opposed their plea calling it "delaying tactic". The agency had also said that the findings of such tests are not admissible as evidence in court.
The Talwars had approached the Supreme Court after the Allahabad High Court dismissed their plea. The Supreme Court said today that there was no reason to interfere with the High Court order.
The three men - Raj Kumar, Vijay Mandal and Krishna - were arrested by the CBI in 2010 and put through narco-analysis test. They were later released after investigators said there was not enough proof to justify keeping them in jail. Krishna worked at the Talwar couple's dental clinic; Raj Kumar was employed as a domestic help with the Talwars' family friends Durranis and Vijay Mandal worked as a helper in the same apartment block where the Talwars lived.
Aarushi was found dead with her throat slit in her bedroom on May 16, 2008. The initial suspicion was on the Talwars' domestic help Hemraj. But his body was later found on the terrace at their residence in Jalvayu Vihar in Noida on the outskirts of Delhi.
According to the CBI, Rajesh and Nupur Talwar are the main accused in the double murder. The agency claims there was no evidence of any third person entering the Talwars' premises on the night of the crime.
