Gangster Abu Salem, currently in a jail in Delhi, may have to be sent back to Portugal. He has won a court case in Portugal against India asking that his extradition be cancelled. Salem had alleged that he was tortured while in custody.
The Central Bureau of Investigation or CBI has decided to challenge the order in Portugal Supreme Court through the Foreign Ministry.
India believes Salem played a key role in the bomb blasts in Mumbai in 1993.
He is currently being tried in connection with an extortion case in 2002.
In 2002, Salem and his girlfriend actor Monica Bedi, were arrested in Lisbon for travelling with fake passports. In November 2005, after a lengthy legal battle, the CBI won its case and Salem and Bedi were both deported to India.
At the time of Salem's extradition six years ago, the Indian government had guaranteed in a Portugal court that he would not be given death penalty or charged with any section of law which entails jail for more than 25 years.
"An order was passed quashing the extradition of Salem to India on the grounds that the Indian government had violated the extradition conditions," Salem's lawyer, Arvind Kumar Shukla told PTI.
The Portugal court's order, which agrees that India has violated the terms of its extradition treaty, will be communicated officially to the Delhi High Court.
