Does Ajmal Amir Kasab pose a danger to his own lawyers? The Bombay High Court will decide on Wednesday if jail authorities need to be present every time Kasab meets them.
In the court, hearing the confirmation of his death penalty, the prosecution had argued that:
- Kasab is dangerous and trained for combat
- He had attacked a jailor in his cell on September 1 - an attack captured on CCTV
- Hence he cannot be permitted to meet his lawyers without guards being present
But Kasab's lawyers argue that the terrorist is uncomfortable discussing the case with authorities in the room. And any discussion between a client and a lawyer is privileged communication.
"It's not like whenever we have gone the guards are not there or the security is not there. It's all bullet-proof glass so it's not like we are not safe," said Kasab's lawyer Farhana Shah.
The defence says that while they don't want to undermine security concerns when it comes to Kasab, in the interest of justice they should be able to speak to their client without the cops or jail authorities being able to listen in.
