Patna: The Bihar Government will file an appeal in Supreme Court against the Patna High Court order acquitted all 23 accused in the Bathani Tola Massacre case, Bihar Chief Minister Nitish Kumar said on Tursday.
A divison bench of the Patna High Court, on April 16, had acquitted all accused who were serving sentence granted by a district court in the case.
On July 11, 1996 , 21 people were gunned down in Bathani Tola in Bhojpur district in Central Bihar.
The district court while declaring guilty 23 accused, gave three accused sentence to death and remaining 20 accused had been given life sentences. However, the PatnaHigh Court rejecting this order saying the involvement of the accused could not be proved beyong reasonable doubt.
The government's decision comes after heavy criticism especially from the CPI (ML) whose cadres had lost their lives in this carnage. Union Home Minister P Chidambaram too had commented that media had not highligted this judgement and took up the cause of victims like the Jessica Lal case.
