The Delhi High court on Friday allowed the urgent listing of plea moved by Delhi Police against the discharge of 11 persons including student activists Sharjeel Imam, Asif Iqbal Tanha, Safoora Zargar, who were previously accused in 2019 Jamia Millia Islamia (JMI) University violence.
The division bench headed by chief justice Satish Chandra Sharma allowed the urgent listing of the matter for hearing on Monday, which was mentioned by Solicitor General Tushar Mehta.
The plea against the persons previously accused in Jamia Violence was moved by the Delhi Police after the Saket Court in the national capital discharged them on Saturday (February 4) and directed to frame charges against Mohd. Iliyas alias Allen in the matter.
The Saket court had made serious remarks in the case during the hearing last week and said that the Sharjeel Imam and others were made scapegoats in the matter.
The court had said that police had no evidence against the said accused persons and discharged them.
This case pertains to violence in Jamia and surrounding areas in December 2019, which erupted after a clash between the people protesting against Citizenship Amendment Act (CAA) and the police.
Notably, Sharjeel Imam was granted bail in 2021 and was discharged on February 4 with other activists lodged in the Tihar Jail.
The Delhi Police registered a case at Jamia Nagar Police Station in connection with the violence that broke out on December 13, 2019, and named 12 persons accused in the case.
The police registered the alleged offence of rioting and unlawful assembly and Sections 143, 147, 148, 149, 186, 353, 332, 333, 308, 427, 435, 323, 341, 120B and 34 of the Indian Penal Code (IPC) were invoked in the First Information Report (FIR).
However, Imam will remain in custody as he is accused in a larger conspiracy or a Delhi riots case and a sedition case.
His bail in larger conspiracy case and sedition case was dismissed by the Karkardooma court.
