Ethic Indian man wins Rs 20 lakh compensation

Kuala Lumpur: An ethnic Indian man was today awarded Rs 20 lakh in damages by a Malaysian court after a hospital misdiagnosed him for being HIV positive. The court ordered Adventist Hospital and Clinic Services (M) Bhd to pay 54-year-old A Nageswara, 100,000 ringgit for medical negligence and 50,000 ringgit for defamation.

A Nageswara, went into hiding and left his family behind, after he was misdiagnosed. The court ruled that the hospital was negligent in conducting the unnecessary HIV test on Nageswara, who was admitted to the hospital on April 19, 2001, for a chest injury.

It also found that the hospital had defamed Nageswara when it wrote a letter to his insurance company informing that he had been found to be HIV positive. Outside the courtroom, a happy and relieved Nageswara said he would be reuniting with his wife and five children whom he had not seen for nearly 10 years, online star newspaper said.
