Varanasi: A court today agreed to hear a group of Hindu women who want year-long access to pray inside the Gyanvapi mosque in Varanasi, next to the famous Kashi Viswanath temple. The judge looked at 3 Acts and said none bar the case of the Hindu women.

  1. The five Hindu women are only demanding right to worship Maa Shringaar Gauri and other visible and invisible deities which were being worshipped at the site till 1993 and after 1993 till now once a year under the regulation of the state of Uttar Pradesh.

  2. The court underscored that the suit filed by the Hindu women is "limited and confined to the right of worship as a civil right, fundamental right as well as customary and religious right".

  3. The determination of religious character is a matter of evidence which can be proved by either of the parties, it said.

  4. The Hindu petitioners have laid foundation to establish that the religious character of the property in dispute was of Hindu temple and deities were being worshipped within the property in dispute, the court said.

  5. The Kashi Vishwanath Temple Act does not specifically bar a "suit claiming right to worship idols installed in the endowment within the premises of the temple or outside",  it said.
