Mumbai:
A prosecutor has stirred a controversy by seeking a copy of the judgement in the 26/11 case from the Bombay High Court, without proper authorisation, to be forwarded to Pakistan, prompting his superior to demand an explanation for his conduct.
Additional Public Prosecutor Shahji Shinde, in a letter dated June 29, 2010, had asked the Registrar General of the High Court to furnish a certified copy of the judgement that could be forwarded to the government of Pakistan.
As absence of any outward number on the letter raised suspicion about the official authority of the author to write such a letter, the Registrar General forwarded it to the Chief Justice who referred it to Chief Public Prosecutor Pandurang Pol for inquiry.
"The inquiry found that the letter was written by Shahji Shinde," Pol said, adding that he had issued a memo to the APP asking him to explain his conduct. The memo was delivered to Shinde last night.
"The 26/11 case is very sensitive in nature... that the letter claimed that certified copy has been sought to be sent to Pakistan is a serious issue," Pol said.
He said Shinde should not have written the letter as he was not holding any brief on behalf of the government in this case.
