Mumbai: The Bombay high court has raised questions on the charge sheet filed by Mumbai police in the Jiah Khan suicide case.
The court has asked the police to file a reply by April 7, 2014 as to why all evidence in the case wasn't attached in the charge sheet.
Mahesh Jethmalani, appearing for Jiah Khan's mother Rabiya Khan, argued in the court that new material has come up and the investigating officer should have considered it. He told the court it is a case of homicide and not suicide.
The Mumbai police had filed a 447-page charge sheet in an Andheri court accusing Suraj, son of actor couple Aditya Pancholi and Zarina Wahab of abetting Jiah's suicide on the basis of evidence gathered during the investigation, which did not indicate it was a case of murder.
Actress Jiah Khan who had acted in films like Nishabd opposite Amitabh Bachchan was found hanging at her residence on June 3, 2013. Soon after Jiah's death, her mother had handed over a letter purportedly written by the actor which showed she was in a troubled relationship with Suraj. He was arrested on the charge of abetting her suicide and later granted bail.
Mr Jethmalani said that according to medical reports the cause of death is asphyxia and a blue concussion on the arm is not mentioned in the post-mortem report as it is a mark of struggle.
He added that the mark is seen in a photograph and that it is a case of hanging by muslin cloth used for namaz. He stressed that Muslin cloth cannot make a mark like the one found on her skin.
Mahesh Jethmalani also referred to evidence that suggests she committed suicide after returning from her boyfriend's house. He also brought before the court other evidence like her call and SMS record, urging the court to hand over the investigation to the CBI or a special investigating authority.
Jiah Khan's family had earlier made a similar plea.
