Modi begins fight against summons in riots case
New Delhi: Late last week, the Gujarat riots came back to haunt Chief Minister Narendra Modi when a Supreme-Court-appointed panel summoned him for questioning on a complaint that accuses 63 people, including him, of conspiring to allow the murder of Muslims in 2002. The Chief Minister was asked appear before the special investigating team (SIT) on March 21 on a complaint by Zakiya Jafri, wife of former Congress MP Ehsaan Jafri, who was burnt alive in the Gulbarg Society riots.

Ever since the summons, all eyes were on what Modi would do next. The Chief Minister chose not to speak on the matter.

Now, the Supreme Court has decided to consider an application seeking recall of its order handing over the Zakiya Jafri complaint to the SIT. The application has been filed by a BJP MLA, Kalubhai Maliwad, also an accused in the complaint filed by Zakiya.

In Ahmedabad, meanwhile, a three-judge bench of the High Court headed by Justice D K Jain has asked the trial court to defer its hearing in the Gulbarg Society case. The order was passed in view of a petition filed in the High Court seeking transfer of the case to another trial court judge.

Solicitor General Gopal Subramanium and senior advocate Harish Salve, who is assisting the court in the matter as amicus curiae, informed the bench that Special Public Prosecutor R K Shah had resigned making certain allegations against the presiding officer (Judge) and the SIT.

In her 100-page complaint, Zakiya has said Modi, along with others in his government, conspired to allow the massacre of her husband and nearly 70 other people in Ahmedabad's Gulbarg Society in 2002. She has alleged that Modi and his colleagues instructed policemen and bureaucrats not to respond to pleas for help from Muslims being attacked during the riots.
