Moninder Singh Pandher, an accused in the serial killing of children in Noida near Nithari village, was released on Saturday from Dasna jail after the Allahabad High Court granted him bail on September 24.
"The Nithari co-accused has been in judicial custody for about 8 years. He was arrested in Dec 2006. This month he would complete 94 months in the judicial custody," said Devraj Singh lawyer for Pandher.
Earlier his released was jeopardised due to an error in the release order.
In case number 440 pertaining to the murder of Pinki Sarkar the local court rejected the bail plea of Pandher booked under section 302 and 34 of IPC, Devraj said
Against the rejection Pandher filed application at Allahabad High Court which granted him bail under the same sections.
When the release order reached jail, the jail authorities noticed that case was being tried under sections 302 and 120 (b) of IPC but the bail was granted under sections 302 and 34.
Therefore the jail authorities refused to release him and returned the order to the court.
The Allahabad High Court in its order dated 24 September 2014 ordered his immediate release, said Devraj.
