Four years to the day that 13-year-old Aarushi Talwar was found dead in her bed with her throat slit, her mother Nupur Talwar's bail plea in the Allahabad High Court has been postponed to May 22. This mean Mrs Talwar will stay in the Dasna jail till then.
Mrs Talwar was already denied bail by the CBI court in Ghaziabad 14 days ago. Today the CBI filed a counter affidavit in the Allahabad High Court, opposing her bail plea. The court has given time up to May 22 for Mrs Talwar's legal team to file a response.
"The main ground for seeking bail is parity. Rajesh Talwar is the main accused, and he is out on bail, so on grounds of parity Nupur should also be granted bail," explained Amit Srivastava, the lawyer for Mrs Talwar.
In her bail plea before the High Court, Nupur has said that she has not murdered anybody, and has accused the CBI of conducting an improper and incomplete investigation. She says she has obeyed the court's orders and her good conduct entitles her to bail.
Mrs Talwar however was present at the Ghaziabad Court today where she and her husband Rajesh Talwar are on trial, accused of murdering their daughter. Today, there are crucial hearings connected to Aarushi's murder in three courts simultaneously - the Supreme Court in Delhi, a special court in Ghaziabad and the Allahabad High Court.
The Ghaziabad court hearing arguments on framing of charges against the Talwars has fixed the next date of hearing on May 21. The lawyer for the Talwars today had asked for some more documents related to the case and wanted at least a month to study these. But court rejected it, saying that there are directions from the Supreme Court saying the case should be expedited.
On Tuesday, the CBI handed over three CDs to the Talwars' lawyers and also brought around 6000 pages of documents to be given to the couple.
The Supreme Court is due to hear the Talwars' review petition to quash charges against them. During the last hearing, the top court had said that Nupur 's plea that proceedings against her be quashed was premature.
The Talwars allege that there are lacunae in evidence used to accuse them of the murders of Aarushi and the family domestic help, Hemraj, and so cases against them should be quashed. Hemraj was found murdered a day after Aarushi's body was discovered in her bed.
Rajesh Talwar was arrested soon after the murders and was kept behind bars for 50 days before being set free in July 2008. He was then made an accused in the case, three years later.
