New Delhi:
The Supreme Court will be hearing Nupur Talwar's bail plea today. Mrs Talwar and her husband Rajesh Talwar, both dentists, are accused of killing their 14-year-old daughter Aarushi and their domestic help Hemraj at their home in a Delhi suburb in May 2008. Mrs Talwar has been lodged in Ghaziabad's Dasna jail since April 30.
During the last hearing, the CBI opposed her bail saying few star witnesses have still to be examined and if Mrs Talwar is out on bail, she could influence them.
The Court had accepted the CBI plea and the bench of Justice A.K. Patnaik and Justice J.S. Khehar told senior counsel Sidharth Luthra, appearing for the CBI, to complete the examination of 13 prosecution witnesses before September 17.
The CBI, in its affidavit, has told the court that the accusation of "double murder and destruction of evidence" against Mrs Talwar were "well founded and evidence has started coming in."
Appearing for Nupur Talwar, senior counsel K.V. Vishwanathan had told the court, the CBI's own case was that the Talwars acted in sudden provocation. He also said that the entire case was based on circumstantial evidence.
The senior counsel pleaded that Nupur Talwar could be released on bail, and to address the apprehensions of the investigating agency the court could impose any conditions.
He said that for the same offence, Nupur Talwar's husband Rajesh Talwar was out on bail.
A CBI trial court in Ghaziabad has charged the Talwars under sections 302/34 (murder with common intention) and 201 (destruction of evidence with common intention) of the Indian Penal Code (IPC).
In addition to these, the court charged Rajesh Talwar under section 203 (giving false information in respect of an offence committed) of the IPC.
