Ruchika case: No new FIR against Rathore yet

New Delhi: Three days after Ruchika Girhotra's brother filed a fresh complaint accusing SPS Rathore of not only molesting her, but also abetting her suicide, there is still no FIR in sight despite Haryana Chief Minister Bhupender Singh Hooda saying that an FIR is likely to be registered soon.

Sources have told NDTV that the state government and legal experts are taking their time to ensure the case against Rathore is foolproof this time.

The Supreme Court has already thrown out this charge against the former Haryana DGP once before.

"We are going through the complaint. We have full sympathy for the family and justice will be done the case needs revisit," Hooda said.

On being asked if the Home Ministry has talked to him on this, Hooda said: "We have been talking on so many things. It will be registered since they have filed a complaint. It should be registered after going through the contents. Complaint is as good a FIR, but formally it will be registered."

Sources have told NDTV that once the fresh FIR is registered, the CBI will take over the case. And if convicted for abetting Ruchika's suicide, Rathore may get up to 10 years in jail.

Rathore has got interim baill till January 7 in connection with two FIRs against him. But he can be arrested if the police lodge a fresh FIR - that of abetment to suicide.

Meanwhile, Ruchika's school principal, Sister Sebastina, was questioned by the Chandigarh Sub Divisional Magistrate on Saturday. Ruchika had been expelled from the Sacred Heart convent just weeks after she filed a complaint against Rathore.

The school has, however, claimed that it has gone through the their records and found that Ruchika was expelled because her fees was not paid for six months.

Ruchika was 14 when she was expelled from the school, within a month after being molested by Rathore in Haryana. Her friends and family claim that her expulsion was one of the reasons why Ruchika killed herself in December 1993. After being expelled by Sacred Heart, she used a private tutor and never went to any other school.

As part of a probe to find out why Ruchika was expelled, the Sub Divisional Magistrate of Chandigarh, Prerna Puri, had visited the house of Ruchika's friend and the only eyewitness to the molestation, Aradhna, to get her version.

Aradhana, who has been campaigning for justice in the case, had told NDTV that after Ruchika was molested, she was quiet and depressed in school and would often burst into tears in class. About the official reason given by the school for expelling Ruchika, Aradhana pointed out that Ruchika had been a student there for several years and the school could have warned her family instead of expelling the teenager.

Rathore was convicted 19 years after he molested Ruchika to six months in prison - a verdict that outraged India. The government is now working with Ruchika's family to examine whether Rathore can be charged with abetment of suicide, instead of molestation.
