CBI has started questioning former Gujarat Minister Amit Shah in Sohrabuddin case. He reached at CBI office in Gandhinagar on Saturday morning.
On Friday Gujarat high court finally granted two days police custody of the former minister to the CBI rejecting an earlier order of a lower court which had refused the custody. It was intense day long court battle at the high court.(Read: Gujarat High Court gives 2-day custody of Amit Shah to CBI)
The last time the probe agency questioned Amit Shah was in Sabarmati jail after which the CBI said the former minister didn't cooperate. But this time he is expected to cooperate during the questioning - at least that's what his lawyer suggested.
"We will cooperate in investigation process," said Yatin Ojha , Amit Shah's lawyer.
Yesterday, Shah's Counsel Ram Jethmalani argued that since the CBI had already chargesheeted Shah, it had forfeited its right to police custody.
KTS Tulsi appearing on behalf of the CBI countered this argument stating that the CBI was well within its right to seek custody since Shah had refused to cooperate during questioning in judicial custody.
Tulsi also argued that it was a supplementary chargesheets in the case and the first one had been filed way back in 2007 by the state CID, the CBI was carrying a further investigations in which Shah's role had been established.
The CBI also says it wants to recover some important material evidences like laptop, personal computer and call data records from Shah's possession and that's why his custodial interrogation was necessary.
And with the High Court granting the custody it was relief for the CBI which had drawn criticism earlier for failing to seek Shah's custody. Though it has lost some days in the ensuring court battle but it hopes to get some more leads through Shah's custodial interrogation. The CBI also denied consent to a request by Shah's counsel that his interrogation should be videographed.
"We had made a request for the same but the CBI says it results in wastage of time and cannot be accepted," said Mahesh Jethmalani, Defence Counsel.
