Supreme Court Agrees to Hear Plea Against BJP Chief Amit Shah on Tuesday

New Delhi: Sacked Gujarat police officer Sanjiv Bhat has moved the Supreme Court, seeking an investigation into the role of BJP chief Amit Shah and two others for what he called their role in trying to subvert the process of justice in the 2002 Gujarat riots cases.

Senior advocate Indira Jaising who was representing Mr Bhat, requested Chief Justice HL Dattu to take up the case at the earliest and the court agreed to hear it on Tuesday.

Mr Bhatt -- who was sacked last month for not showing up for work -- had been in the news for alleging that Narendra Modi, then Chief Minister of Gujarat, was complicit in the 2002 riots, in which more than 1000 people were killed.

His claims were rejected by the Special Investigation Team appointed by the Supreme Court to probe nine riots related cases. Mr Modi, who took over as the Prime Minister last year after winning the national election, has never been found guilty of wrongdoing over the riots, and has denied any role in them.

Mr Bhatt had also been booked by the police in 2011 following a complaint that he had hacked into the e-mails of additional solicitor general Tushar Mehta (who was then a prosecuting attorney). The top court, however, had put a stay on the case in 2011.

He told the top court that the Central Bureau of Investigation will be biased while probing the case against him, since the BJP is now in power at the Centre.  He asked the court that a Special Investigation Team be constituted for the purpose and be monitored of the court.

Mr Bhatt's petition also said during the Shorabuddin trial, the affidavits of the state were shared with the accused including Amit Shah and the others and contempt cases should be initiated against Amit Shah, Gurumurthy and GC Badheka.
