Supreme Court refuses to stay order on repairing shrines destroyed in 2002 Gujarat riots
New Delhi: In a setback to the Gujarat government, the Supreme Court today refused to stay the High Court order directing state government to repair religious places damaged in the 2002 post-Godhra riots.

The state government had filed an appeal against the Gujarat High Court order.

The top court today gave an option to formulate a scheme for repairing religious places damaged during the riots on the lines of its earlier order where it had asked the Odisha government to formulate a scheme for repairing churches damage during the 2009 Kandhamal riots.

The Gujarat government told the court that it is working on a scheme to compensate the damaged religious properties when Supreme Court asked about the existence of any scheme.

The bench of Justices K S Radhakrishnan and Dipak Misra posted the matter for further hearing on August 14 and asked the state government to brief it about the scheme on that day.

Even though the court didn't stay the High Court order, it allayed Gujarat government's apprehensions that the order may be used in other litigations.

The Gujarat government was pulled up by the High Court on February 8 for its "inaction and negligence" during the 2002 post-Godhra riots, which had led to large-scale damages to various religious structures.

The High Court had ordered compensation for over 500 places of worships in the state on a plea by Islamic Relief Committee of Gujarat (IRCG), an NGO.

The NGO had contended that 535 religious places were affected out of which 37 are yet to be repaired.

In its July 9 order, the High Court order had directed the state government to settle the claims for damage to the religious places by August. Using strong words, the High Court had said that the riots happened because of the inaction or inadequate action of the Modi government.
