"Contempt Of Court": Top Court's Bar Body On BJP MP's Comments

The Supreme Court Bar Association has condemned BJP leader Nishikant Dubey over his comments against the Supreme Court, saying it was not just defamatory but "amounts to contempt of court".  In a resolution, the association expressed hope that the Attorney General will agree to contempt of court action against the BJP MP. 

"This attack on the Supreme Court, as an Institution, and qua the Chief Justice of India Mr. Justice Sanjiv Khanna, as an individual, is unacceptable and must be dealt with in accordance with the law," lawyers' resolution read today. 

"We do hope that the Attorney General, charged with the responsibility of protecting the Constitution and the laws, who has reportedly received a petition seeking consent to proceed for Criminal Contempt against Mr. Nishikant Dubey, will grant consent to protect the dignity of the Institution and the dignity of the Chief Justice of India Mr. Justice Sanjiv Khanna," added the resolution.

On Sunday, Mr Dubey expressed a series of strong comments against the top court, saying Parliament and state assemblies should be shut if the court makes laws. 

He also took a swipe at Chief Justice India Sanjiv Khanna, holding him responsible for "civil wars" in the country.

"The Parliament makes the law of this country. You will dictate that Parliament?... How did you make a new law? In which law is it written that the President has to take a decision within three months? This means that you want to take this country towards anarchy. When the Parliament sits, there will be a detailed discussion on this..." said Mr Dubey, sparking waves of criticism. 

The BJP has distanced itself from Nishikant Dubey's comment. "The BJP has nothing to do with the statements made by BJP MPs Nishikant Dubey and Dinesh Sharma on the judiciary and the Chief Justice of the country. These are their personal statements, but the BJP neither agrees with such statements nor does it ever support such statements. The BJP completely rejects these statements," posted BJP chief JP Nadda on X, formerly Twitter.
