New Delhi: Real estate major Unitech Ltd top bosses, facing charges of alleged cheating, today succeeded in getting interim bail, a few hours after being sent to 14-day judicial custody by a magisterial court.
Unitech Ltd Chairman Ramesh Chandra, Managing Directors Sanjay Chandra and Ajay Chandra and Director Minoti Bahri were enlarged on three day interim bail by a sessions court after they gave an undertaking that they will honour the order of a State Consumer Forum and settle all pending dues to two complainants.
The sessions court order came over three hours after they were sent to 14-days judicial remand by a magisterial court.
Giving relief to them, Additional Sessions Judge Vimal Kumar Yadav said "the applicants are ready and willing to honour the undertaking given before the state consumer forum / sessions court with regard to the payment to be made to complainants. In view of the same, since the complaint is also not opposed to the grant of interim bail therefore the applicants, Ramesh Chandra, Ajay Chandra, Sanjay Chandra and Minoti Bahri are admitted to interim bail till January 14."
The court also asked the accused to furnish a personal bond of Rs one lakh each with and a surety of the like amount and posted the matter for further hearing on January 14.
The complainants - chartered accountant Sanjay Kalra and his business partner Devesh Wadhwa - had booked a property in Habitat Apartments in Greater Noida developed by Unitech. The project was delayed and before the State Consumer Commission and sessions court last year, the company had promised to refund the amount along with simple interest of 11 percent per annum by October last year.
The complainants had claimed that despite the court's earlier order, Unitech had not refunded them the complete payment.
The relief to Unitech bosses came after they moved the District Judge against the order of Additional Chief Metropolitan Magistrate Gaurav Rao, who had earlier in the day refused them bail and sent them to judicial custody.
The magistrate observed that the complainants have undergone "trauma" and asked "has anyone seen the hardship faced by the complainants? Has anyone seen the trauma undergone by them all these years?"
