The Rajasthan High Court has given the custody of an 11-year-old girl and her younger brother, 7, to their mother after taking note of her YouTube videos that were allegedly shot when she lived with her grandparents on the father's side.
Their mother had filed a habeas corpus petition in the court after she left her marital home following the death of her husband. Her in-laws had refused to give her the custody of her minor children.
She alleged her in-laws were not taking proper care of her children and showed the court her daughter's YouTube videos, one of which showed her posing with a syringe.
Taking a stern view of the videos, a bench of Justice Pankaj Bhandari court pointed out the impact of social media on children.
The grandparents were negligent and "irresponsible in the upbringing (of the children) ", it held and transferred their custody to their mother.
"It's astonishing that such a young child is making these kinds of videos. She is posing with a syringe and pressing someone's throat. The kind of horror dramatics that she is doing and the grandparents are completely unaware. She is running a YouTube channel. It's not possible she is doing all these by herself. Obviously, other people are involved," Manish Sharma, the lawyer for the mother, told NDTV.
He argued in the court that the grandparents were old and not able to take care of the children. The girl eats junk food and they are not aware of her health, he claimed.
Speaking to NDTV, the mother said she had stopped her children from using the mobile phone, but their grandparents would give it to them. "By doing this, they turned my children against me."
The girl's grandfather said they were not aware that she made such videos. He turned the blame on their maternal grandmother saying said she had control over the YouTube channel.
Stating that her daughter-in-law had distanced them from their grandchildren by making baseless allegations, he said he would challenge the high court's decision in the Supreme Court.
He also said the videos were shot before the girl lost her father.
