Maharashtra Government Suspends Prison Sentence of 11 Encounter Cops

Mumbai: The Maharashtra government has suspended the life sentences of 11 policemen convicted in the Lakhan Bhaiyya fake encounter case for six months.

The order was issued on Wednesday by the Maharashtra Home department using its powers under the Criminal Procedure Code.

"This decision has been taken after consideration of the report submitted by the police authorities, and the report given by the honorable court which had awarded the initial sentence. Also, we have considered the report of the human rights commission," said Principal Secretary (Home) Dr Vijay Satbir Singh.

"There are certain conditions in their order of suspension of sentence, and they will have to abide by the conditions. They will have to maintain contact with the police and report to them from time to time. They will have to surrender their passports. We will make sure that they observe these conditions and we will take a review after a period of six months," Dr Singh added.

Under the Code of Criminal Procedure 1973, the state government has the power to suspend the sentence of a convict if certain conditions are met. The decision will be reviewed after six months to see if the sentence can be suspended further.

"We also have to keep in view the fact that these people worked overtime to ensure the gang-war in Mumbai is finished off. Today there is no underworld which is strong enough to disrupt peace in Mumbai. So when all these factors are considered, I think the suspension of sentence for six months would be consistent with the basic parameters of equality," said lawyer and activist YP Singh.

The 11 policemen were convicted by the sessions court in 2013. Suspected Chhota Rajan aide Ramnarayan Gupta also known as Lakhan Bhaiya was killed in Versova in suburban Mumbai in November 2006. A police team picked him up from Navi Mumbai on November 11, 2006 and he was killed on the same day. Encounter specialist Pradeep Sharma, who has carried out more than 100 encounters, was acquitted in the case.
