Three acquitted in BEST driver assault case

Mumbai: A sessions court has acquitted three persons, including a lady, accused of allegedly assaulting a BEST bus driver in 2007.

The trio - Mukesh Padam, Dinesh Padam and Sushma Jalgaonkar - were accused of assaulting BEST bus driver Rohidas Durgade (49) in January 2007 in central Mumbai after he refused to let them overtake the bus.

According to the prosecution, Durgade was plying on bus number 61 from suburban Mahim to Nariman Point in south Mumbai when at Chinchpokli in central Mumbai, a Maruti van overtook him and halted in front of the bus.

The trio then allegedly abused Durgade and forcibly entered the bus and started assaulting him. While Mukesh and Dinesh kicked Durgade, Sushma assaulted the driver with her chappals.

The prosecution examined seven witnesses in the case including the bus conductor and a passenger.

"The court acquitted all the three accused due to lack of evidence. It disbelieved the prosecution witnesses," defence lawyer R B Mokashi said.
