Madurai: Former DMK Minister I Periyasamy, arrested on June 4 on charges of illegal quarrying, filed a bail application on Thursday in the Madras High Court bench in Madurai in connection with the case against him in this regard.
Periyasamy contended that the prosecution's case, filed under Sections 420 and 379 of the Explosives Substance Act, was false. He could not be arraigned as accused in the case as per materials available as it would not attract provisions of the ESA.
Periyasamy said that when the confessional statement of the main accused had been disowned before the Judicial Magistrate, he could not be arrested on that ground.
He also alleged his arrest was due to political vendetta as he had been elected MLA for the fourth time. People would not be able to air their grievances to him if he was arrested on a 'false case,' he said.
He alleged that police had altered documents presented before the Dindigul district and sessions Judge where his bail application was rejected on June 11, after his arrest.
Periyasamy sought grant of bail stating that he was diabetic and a heart patient and had recently undergone an angiogram. He also said he had a permanent address and was willing to cooperate with police in connection with the case.
The application will come up for hearing on Friday.
