New Delhi:
The Tamil Nadu claim over the additional power surrendered by Delhi during winter cannot be decided without hearing other states, the Centre told the Supreme Court on Thursday.
"Other requesting states/agencies are necessary parties and ought to be heard/impleaded as they may be prejudiced in the event of any order being passed" on Tamil Nadu's plea for allocation of entire power being surrendered by Delhi, the Centre told a bench of Chief Justice Altamas Kabir and Justice J Chelameswar.
Tamil Nadu government has moved the court for a direction to the Centre to allocate it 230 MW of power round the clock and 1491 MW power from midnight to 6 am, being surrendered by Delhi government.
The Centre, in its reply, said the National Thermal Corporation (NTPC), during September-October, wrote letters to various power utilities/ departments in different states/Union Territories including Tamil Nadu Generation and Distribution Corporation Ltd (TANGEDCO) enquiring about their requirements.
Power Utilities of Assam, Uttar Pradesh, J&K, Dadar & Nagar Haveli, Kerala, Andhra Pradesh, Karnataka, Bangalore also made applications for allocation of power to be surrendered by Delhi, it said.
The Centre said that Tamil Nadu's plea for entire surrendered power cannot be allowed without hearing other applicants.
