A woman or girl being of easy virtue or habituated to sexual intercourse cannot be reasons to absolve someone of rape, especially a father who is expected to be the "fortress and refuge" of his daughter, the Kerala High Court has said.

Even if a woman is of 'easy virtues', she cannot be subjected to rape, the Supreme Court has held, saying courts have a duty to determine whether the offence has been committed or not.
