The idea of social diversity in higher judiciary has been long debated. Last week the Law Minister told Parliament that nearly 80% of the High Court judges appointed since 2018 belong to the general category. The representation of the backward communities and the minorities remains abysmal. Without a provision of mandated reservation of judges in higher judiciary, how do we ensure adequate representation of those historically oppressed in the justice system, after all, inclusivity ensures more responsive institutions, that in turn champion the rights of all.
