This week the crucial hearing over instant triple talaq began in Supreme Court. A constitutional bench of the court is looking at the issues of whether instant triple talaq is fundamental to Islam? Whether it is a sacrosanct part of Islam and if instant triple talaq is an enforceable fundamental right? Muslim women, who have been at the receiving end of triple talaq, have found it to be regressive and subverting their fundamental rights under the constitution. The All India Muslim Personal Law Board and few other organisations, however, argue that instant triple talaq is an inalienable part of Islam. They fear that any ruling which would go against the principle of instant triple talaq would lay the groundwork for establishing a Uniform Civil Code in the future although women's organisation and the ruling party have quelled this doubt.
