Desh Ratan Nigam, a Supreme Court Advocate who is in support of the government on the matter of the appointment of judges said that the NJAC Act was passed in Parliament unanimously in 2015 and as such the judiciary does not have the power to amend the constitution. He emphasised that the power to amend the constitution is vested in the executive alone. He believes that the judiciary is in need of a final check-and-balance and maintained that "we live in a parliamentary democracy, where the will of the people is supreme".
