A landmark hearing in the Supreme Court began to assess the constitutional validity of triple talaq, the controversial form of Muslim divorce. The bench hearing the case comprises the senior most judges in the Supreme Court. Today, the Chief Justice of India spelt out how they would go about examining the case. Firstly, is triple talaq a fundamental element of Islam and if that is the case the court will not intervene. Is triple talaq part of an enforceable fundamental right?
